The EU data ruling: Inviting all terrorists

he European Union, a 25-member melange of malaise in the war on terror, would rather protect data than lives. To rationalize annulling a crucial security agreement with the U.S., the European Court of Justice, the EU's supreme court based in Luxembourg, essentially said "commercial" does not mean commercial. The court ruled that EU protection law covers only commercial data and not that used for security purposes. If the United States considers the EU an ally in fighting terrorism, Osama bin Laden is the least of America's problems.

The Bush administration previously warned it would impose heavy fines and deny landing rights for any airline failing to comply with the data-sharing agreement. Should the EU court's ruling stand, Washington must be prepared to follow through.
